Please read these Terms and Conditions carefully before using Pixellect. Pixellect is a Tailored AI project operated by Tailored AI LLC. By accessing or using the Pixellect website, application, AI features, or related services, you agree to be bound by these Terms.
Interpretation and definitions
Words with an initial capital letter have the meanings below. These meanings apply whether the words are used in the singular or plural.
Account
“Account” means an account created for you to access Pixellect or parts of the Service.
Company
“Company,” “we,” “us,” and “our” refer to Tailored AI LLC.
Credits
“Credits” are usage units that may be required for certain AI-assisted operations or other paid features in Pixellect. Credits are not money, are not a deposit, and cannot be redeemed for cash except where required by law.
Device
“Device” means any device that can access the Service, including a computer, phone, or tablet.
Feedback
“Feedback” means suggestions, ideas, or comments you send us about Pixellect or its features.
Service
“Service” means the Pixellect website, macOS application, editor, AI-assisted features, credit system, and related services provided by the Company.
Terms
“Terms” means these Terms and Conditions, which form the agreement between you and the Company regarding use of the Service.
You
“You” means the person accessing or using the Service, or the company or other legal entity on whose behalf that person is doing so.
Acknowledgment and acceptance
These Terms set out the rights and obligations of all users of Pixellect. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
If you do not agree with any part of these Terms, you may not access or use the Service. Your use of the Service is also subject to our Privacy Policy, which explains how we handle information.
You represent that you are at least 18 years old, or that you have the permission of a parent or legal guardian to use the Service. We do not knowingly permit children under 13 to use the Service.
Pixellect and AI-assisted features
Pixellect is designed to help you work with images. AI features may interpret instructions, generate or modify image content, and perform other operations requested by you. AI-generated or AI-assisted results can be inaccurate, unexpected, incomplete, or unsuitable for a particular purpose. You are responsible for reviewing results before relying on, publishing, or distributing them.
You must have the rights and permissions needed to submit images, prompts, references, and other material to the Service. You are responsible for ensuring that your use of Pixellect does not infringe another person’s rights or violate applicable law.
Accounts
When you create an Account, you must provide information that is accurate, complete, and current. Failure to do so may result in suspension or termination of your Account.
You are responsible for safeguarding credentials used to access the Service and for activity carried out through your Account. You must notify us promptly if you become aware of unauthorized access or another security breach. You may not use another person’s name, a name or trademark you do not have permission to use, or a username that is unlawful, offensive, vulgar, or obscene.
Credits and paid features
Some Pixellect features may require Credits or another paid entitlement. The price, number of Credits, and any applicable terms will be shown before you complete a purchase. Payment processing may be handled by a third-party payment provider, whose terms may also apply.
Credits are added to the Account associated with the purchase. Unless the purchase page says otherwise, purchased Credits do not expire, are not transferable, and may not be sold, exchanged, or combined with another Account. Credits are consumed when the relevant operation is started or completed as described in Pixellect.
Except where required by law or expressly stated at the time of purchase, paid fees are non-refundable. If you believe a charge or credit balance is incorrect, contact us promptly so that we can investigate it.
Our Refund Policy provides additional information about refund requests and legally required consumer rights.
We may change prices, Credit packages, or paid features. A change will not alter Credits already purchased unless required to protect the Service or comply with law. Continued use after a price or feature change means you accept the updated terms for future purchases.
Your content
You retain your rights in images, prompts, and other content you submit to Pixellect. You grant the Company and its Service Providers a limited, worldwide, non-exclusive license to host, process, transmit, and reproduce that content only as reasonably necessary to operate the Service, provide requested AI features, maintain security, and provide support.
You represent that you own or have permission to use the content you submit and that our processing of it as described above will not violate the rights of another person or entity. We do not claim ownership of your content.
Feedback
If you provide Feedback, you grant the Company a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, disclose, sublicense, distribute, and otherwise exploit that Feedback without restriction. This does not give us ownership of your images or other content submitted for editing.
Links to other websites and services
Pixellect may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for their content, privacy policies, or practices. You acknowledge that the Company is not responsible for damage or loss caused by or connected with your use of third-party content, goods, or services.
Termination
We may suspend or terminate access to the Service immediately, without prior notice or liability, if we reasonably believe that you have breached these Terms, used the Service unlawfully, endangered the Service or another user, or created a security or legal risk.
Upon termination, your right to use the Service ceases immediately. If you wish to stop using Pixellect, you may simply discontinue using the Service or contact us about your Account.
Limitation of liability
To the maximum extent permitted by applicable law, the total liability of the Company and its suppliers under these Terms, and your exclusive remedy for all claims, is limited to the amount you actually paid through the Service during the twelve months before the event giving rise to the claim, or 100 USD if you have not purchased anything.
To the maximum extent permitted by applicable law, the Company and its suppliers will not be liable for special, incidental, indirect, consequential, exemplary, or punitive damages, including loss of profits, loss of data, business interruption, loss of privacy, or similar losses arising from or related to your use of, or inability to use, the Service.
“As is” and “as available” disclaimer
The Service is provided “AS IS” and “AS AVAILABLE,” with all faults and defects and without warranty of any kind. To the maximum extent permitted by applicable law, the Company disclaims all express, implied, statutory, and other warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
The Company does not warrant that Pixellect will meet your requirements, produce any intended result, work with every other system or application, operate without interruption, meet a particular performance standard, or be free of errors or defects. This disclaimer does not limit rights that cannot lawfully be excluded.
Governing law
The laws of Germany, without regard to conflict-of-law rules, govern these Terms and your use of the Service, except where mandatory laws in your place of residence provide otherwise.
Dispute resolution
If you have a concern or dispute about Pixellect, you agree to first try to resolve it informally by contacting the Company at help@tailoredpod.ai.
European Union users
If you are a consumer in the European Union, you benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms removes or limits rights that cannot legally be waived.
United States legal compliance
You represent and warrant that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not listed on a United States government list of prohibited or restricted parties. You also agree not to use the Service in violation of applicable export-control or sanctions laws.
Severability and waiver
If a provision of these Terms is found to be unenforceable or invalid, it will be changed and interpreted to accomplish its purpose to the greatest extent permitted by law, and the remaining provisions will remain in effect. A failure to enforce a right or require performance of an obligation does not waive that right or obligation in the future.
Translation and interpretation
These Terms may be translated for convenience. If there is a dispute, the original English text controls to the extent permitted by law.
Changes to these Terms
We may modify or replace these Terms at our discretion. If a revision is material, we will make reasonable efforts to provide notice before it becomes effective and will update the date at the top of this page. By continuing to access or use Pixellect after revised Terms become effective, you agree to be bound by them. If you do not agree, stop using the Service.
